Attorney General Eric Holder has re-defined “due process”. I’ve always thought it meant trial by jury, but Holder, referencing Anwar al Awlaki the accused terrorist targeted and killed by drones in Yemen, said “…‘due process’ and ‘judicial process’ are not the same, particularly when it comes to national security.”
I worry about the implications Awlaki’s murder may have for our rights.
Our Fifth and Sixth Amendments guarantee due process and describe exactly what’s involved. Awlaki, an American citizen, received none of it.
Instead, he received Holder’s new streamlined “due process”… “Trial by Drone” the Executive branch decided Awlaki needed to be whacked, so they whacked him.
Sure, doing things Holder’s way is efficient, but real, honest to god trials are a basic defense against governmental overreach. If judicial due process can be ignored for this US citizen, it can be ignored for anyone the government deems a threat to national security.
